Pilot agreement.
Surve is early. This agreement covers a free 90-day pilot between you (the business using it) and Surve. It sits alongside the terms, the privacy notice and the data processing agreement; where this document differs from the terms, this one wins for the duration of the pilot.
It is deliberately a two-way agreement rather than a free gift. You get the product for nothing; we ask for feedback, a couple of conversations and permission to say you used it. That is not a formality — under English law an agreement where only one side gives something can turn out not to be a contract at all, and if there is no contract then the data protection agreement you are relying on is not binding either. Both of us are better off with real obligations on both sides.
1. How long it lasts
Ninety days from the day you connect a mailbox. It then ends automatically. Nothing renews, nothing starts charging, and no card is involved at any point.
Either of us can end it earlier, for any reason or none, by saying so. If you end it, sending stops immediately.
2. What you get
- Surve reading the mailbox you connect, drafting replies in your business's voice, and sorting what arrives.
- Everything held for your approval by default. You decide, per category, when it may send on its own.
- Setup help from a person, and a reply from a person when you ask a question.
- Your data out, in a usable format, whenever you ask — during the pilot or after.
3. What we ask in return
These are real obligations, not a wish list. They are what makes this an agreement.
- Feedback. Tell us when a draft is wrong, and roughly why, within about a week of noticing. This is the single most useful thing you can give us, and it is also how the product learns your voice.
- Two conversations. A short call near the start and another near the end. Thirty minutes each, at a time that suits you.
- Permission to name you. We may say that your business used Surve, and use your name and logo to say it. We will not quote you or publish anything you said without checking the wording with you first. You can withdraw this on request.
- Patience with a young product. Things will be wrong sometimes. You agree to read what it writes before it goes out, at least until you have decided it is trustworthy enough not to.
4. This is early-access software
We are telling you plainly rather than burying it: Surve is new, it is being changed while you use it, and it will make mistakes. It may be unavailable without warning. Features may change or disappear. There is no service level agreement and no uptime commitment during the pilot — we aim to be running all the time, and that aim is not a promise you can hold us to.
It takes roughly a fortnight of your corrections before the writing really sounds like you. That is normal and it is why the pilot is ninety days rather than seven.
5. What it will never do
These are enforced in the software, not left to the AI's judgement:
- It cannot quote a price, offer a discount, promise a refund, or agree a figure. Anything about money is held for a human every time.
- It cannot move money, take a payment, or touch a payment system. There is nothing in it that can.
- It cannot send while you have it paused, and pausing takes effect immediately.
- It cannot link to a website other than yours.
Every reply carries a line saying the address is AI-assisted, so the person you are writing to knows and can ask for a human.
6. What you must not use it for
During the pilot, Surve must not be used for mailboxes carrying:
- information covered by legal professional privilege;
- clinical or patient information;
- information handled under FCA regulation.
This is not a judgement about those trades. It is that solicitors, clinicians and regulated advisers carry confidentiality duties of their own that an AI reading their correspondence would cut across, and we would rather say so now than find out later. Talk to us if this is you — it is a "not yet", not a "no".
Also, and obviously: not for unsolicited bulk email. Surve answers people who wrote to you first.
7. Your data
We process the mail in your connected mailbox in order to draft replies, and for nothing else. We do not use it to train anyone's model. The data processing agreement sets out the detail and applies in full during the pilot — being free changes none of our data protection obligations.
Mailbox credentials are encrypted before they are stored. You can disconnect at any time and it stops that moment.
When the pilot ends, tell us to delete and we will, within 30 days, and confirm it. If you say nothing, we will delete the mail content within 90 days of the end and keep only what we need for our own records.
8. If something goes wrong
We take responsibility for getting things wrong, within a limit that is stated honestly rather than set to zero.
Our total liability to you under this pilot is limited to £5,000.
We have set a real number rather than "the fees you paid", because the fees you paid are nothing, and a cap of nothing is not a cap — it is a way of saying we accept no responsibility at all while appearing to. Why we think £5,000 is a fair line for a free pilot: you are paying nothing; the product is expressly early access and you know it; you keep human review over what goes out unless you actively turn it off; and you can stop it instantly at any time.
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. This limit does not apply to our data protection obligations, where the law sets the position and we do not get to write our own.
9. What happens on day 91
Nothing automatic. The pilot expires and we talk about whether you want to carry on. If you do, we will agree paid terms and you will sign something new — this agreement does not roll into a paid one, and you will never be charged because you forgot to cancel.
If you do not, we help you disconnect cleanly and delete your data.
10. Law
This agreement is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
